Texas Government Code § 411.204 requires businesses that derive 51% or more of their revenue from on-premises alcohol consumption to display a red “51% sign” at every entrance. This sign prohibits firearms possession on the premises by all carriers.

Your responsibility is simple: do not carry in 51% establishments.

The 51% prohibition differs from 30.06/30.07 signs in three critical ways:

  • It applies to both LTC holders and constitutional carriers
  • Violation is a third-degree felony (2-10 years in prison, up to $10,000 fine)
  • No defense exists for being asked to leave and departing—these are prohibited places

The sign features “51%” in large red letters. For LTC holders, proper posting is required for prosecution. Constitutional carriers can be prosecuted even without signage if the business meets the legal threshold.

The Texas Alcoholic Beverage Commission determines 51% status and enforces signage requirements. LTC training covers 51% locations extensively precisely because of the felony consequences.

Bottom line: The 51% sign marks locations where Texas law makes firearm possession a felony offense regardless of license status.
