Under Texas Penal Code §46.13, a person can face criminal liability if a child under 17 gains access to a loaded firearm that was not secured with criminal negligence. The law does not care about good intentions. It cares about whether the firearm was secured and whether a child got to it.
Core Principles:
- Store loaded firearms in a locked container or render them inoperable with a proper locking device when not under your direct control.
- The adults responsible for the firearms are the only people who need to know the exact location and method of storage.
- Children should be taught the rules. They do not need the combination, the biometric, or the mounting details.
- Quick-access devices have a place for defensive firearms, but they still need to meet the “secured” standard when children are in the home.
Your storage method is a tool for preventing unauthorized access and for meeting legal requirements. It is not content.
